Terms of Use
These Terms of Use (“Terms”) are an agreement between you and theFour (“we”, “us”), the independent app studio that operates the Daybound app and related services (the “Service”).
1. Acceptance
By creating an account or using Daybound, you accept these Terms. If you do not agree, do not use the Service.
2. The Service
Daybound is a shared journal: you create daily pages with text, drawings, stickers, and photos, optionally share books with other people, and — on the Premium plan — back up photos to the cloud and unlock additional features. We may add, change, or remove features over time.
3. Your content
You own it. You retain all ownership rights in the content you create or add to Daybound — text, drawings, photos, and page designs (“User Content”).
License to us. So that the Service can work, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, and display your User Content — solely as needed to provide, maintain, and improve the Service you request (for example syncing a shared book to the person you share it with, backing up photos, or producing an export or physical product you order). This license includes the right to pass your User Content to service providers acting on our behalf for those purposes, and it ends when the content is deleted from the Service, except for copies already delivered at your request.
4. Acceptable use and your responsibility for content
You agree to use the Service only for lawful purposes. You warrant that you own or have all necessary rights, licenses, and permissions to any content you add to the Service, and that your content does not infringe any third party's copyright, trademark, privacy, publicity, or other rights, and is not unlawful. Do not upload content you do not have the right to use — this includes photos of other people used without permission where the law requires it.

5. Subscriptions
- Daybound Premium is an auto-renewable subscription. The price and billing period are shown in the app before you buy.
- Payment is charged to your Apple account at confirmation of purchase. The subscription renews automatically unless cancelled at least 24 hours before the end of the current period.
- You can manage or cancel your subscription at any time in your App Store account settings. Deleting the app does not cancel a subscription.
- We do not process refunds directly. Refund requests are handled by Apple under Apple's terms.
6. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that content will never be lost — keep your own copies of anything irreplaceable.
7. Limitation of liability
To the maximum extent permitted by law, theFour will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from or related to your use of the Service. Our total liability for all claims relating to the Service will not exceed the amount you paid us in the twelve months before the claim arose. Nothing in these Terms excludes liability that cannot be excluded by law.
8. Indemnification
You agree to indemnify, defend, and hold harmless theFour and its officers, employees, and agents — and any service providers or fulfillment partners acting on our behalf, including partners who manufacture or deliver physical goods produced from your User Content at your request — from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) User Content you add to the Service or ask us to process, reproduce, or fulfill; (b) your breach of these Terms, including the warranties in Section 4; or (c) your violation of any law or third-party right.
9. Termination
You may stop using the Service and delete your account at any time in Settings. We may suspend or terminate your access if you materially breach these Terms or if the law requires it. Sections 3 (for content already delivered), 6, 7, and 8 survive termination.
10. Governing law
These Terms are governed by the laws of the United States, without regard to conflict-of-law rules. Courts located in the United States have jurisdiction over disputes, except where the law of your place of residence grants you mandatory protections or venue.
11. Changes to these Terms
We may update these Terms. We will update the effective date above and, for material changes, notify you in the app before they take effect. Continued use after a change takes effect means you accept the updated Terms.
